Pursuant to the Benefit Assessment Act of 1982 (Government Code 54703 et. seq.), Reclamation District 2140 (RD 2140) is undertaking proceedings to consider a permanent operations and maintenance assessment (O&M) on properties within RD 2140. The proposed O&M assessment is necessary to fulfill the financial obligation required by the United States Army Corps of Engineers (USACE) to operate and maintain the newly built Hamilton City Levee once constructed.
In accordance with Proposition 218, an Engineer’s Report has been prepared and is on file with the Secretary of RD 2140. The Report includes a description of O&M services to be provided, description of the cost of services and a description of each parcel proposed to be subject to the assessment. The Report establishes each benefiting property’s assessment based on its proportional benefit received relative to the benefit received by all of the properties in RD 2140 benefiting from the O&M services.
A copy of the Engineer’s Report is on file in the Hamilton City Community Services District office, located at 211 Main Street, Hamilton City, CA and posted at www.rd2140.org.
Each record owner, or the legally authorized representative of such record owner, of property within the RD2140 boundaries proposed to be assessed has the right under the provisions of Article XIII D of the California Constitution (“Proposition 218”) and the Proposition 218 Omnibus Implementation Act, found at Government Code section 53750 et seq., to submit a ballot in favor of or in opposition to the proposed assessment.
Notice of a public hearing and ballots have been mailed to each record owner of property and property owners will have no less than 45 days to return ballots to RD 2140. Property owners with inquiries regarding the Ballot Proceeding can contact RD 2140 at www.rd2140.org. The RD 2140 Board of Trustees will conduct a Public Hearing at the date and time listed below. All interested members of the public are encouraged to attend.
